Roadside Screening Devices Kept Busy This Weekend

On Friday, March 22, 2019, at approximately 5:10 pm, officers were dispatched to the 100 block of Christina Street North regarding a motor vehicle collision that had occurred. Information received at the scene was that one of the vehicles was pulling out of its parking spot along Christina Street when it struck another vehicle that was driving by.

As the investigation continued the officer investigating the matter formed grounds to demand a sample of breath be provided into a roadside screening device from the driver of the vehicle who was pulling out of the parking spot. Upon completion of the roadside screening test a “Fail” was indicated by the instrument and the accused was arrested for having 80 mg, or more, of alcohol per 100 ml of blood. The accused was then transported back to the station where further testing was conducted on the Intoxilyzer 8000C which confirmed that the individual, Andrew John Pearson, 56 years of age, of Forest, had over 80 mg of alcohol per 100 ml of blood and was charged accordingly.

On Saturday, March 23, 2019, at approximately 2:00 pm, officers from the Sarnia Police Service were dispatched to the area of Vimy Crescent and Massey Crescent to check on the welfare of a female sitting in a vehicle with the engine running for approximately an hour.

Officers spoke with the female and noticed that she appeared to be distraught and that a nearly empty bottle of wine was present on the passenger seat beside her. The officer formed grounds to demand that a sample of breath be provided into a roadside screening device.

A number of attempts to provide a sample of breath into the roadside screening device were met with failure by the accused and she was warned that she would be charged for refusal if she did not comply. She was again given a number of opportunities to supply a sample of breath which were also met with failure.

The accused, Yesina Cruz De Molina, 44 years of age of London, was subsequently charged with failing to comply with a demand to supply a sample of breath.
