On September 18, 2021, a fare was picked up by a local cab driver and was to be driven to the area of Quinn Drive. During the cab ride the fare noticed that the driver presented as if he may be under the influence of alcohol.
Once the passenger was clear of the cab the fare contacted the police out of concern for the public’s safety. Officers were able to locate the driver and the vehicle in the area of Russell Street North. A demand was made for the driver to supply a sample of breath into an Alcohol Screening Device and once the test was completed a fail was indicated.
At this time the driver was taken into custody and transported to the Sarnia Police Headquarters to be tested on the Intoxilyzer Instrument by a qualified breath technician. Upon completing the tests, it was determined that the driver indeed had a blood alcohol level over 80 mg of alcohol per 100 ml of blood.
As a result, the accused, Donald Richard Kemsley, 62 years of age, of Sarnia, was charged with impaired operations of a conveyance and for having a blood alcohol concentration of 80 plus.
Kemsley’s first court appearance will be on November 9, 2021, 9:30 AM, at the Sarnia Lambton Courthouse, located at 700 Christina Street North.
The accused has also had his driver’s licence suspend for 90 days (Administrative Driver’s Licence Suspension) and the vehicle he was driving was also impounded for seven days.
