On May 16, 2020, at approximately 5:15 AM, Sarnia Police responded to a roll over collision involving a single motor vehicle on Churchill Line just west of Mandaumin Road. Upon arrival officers observed that the motor vehicle had rolled over into the ditch and was totally destroyed. Fortunately, the driver and a passenger did not sustain any significant injuries and were still present at the scene.
Upon identifying the driver, the officer administered the Alcohol Roadside Screening Device. Once the test was administered results indicated a fail and the driver was arrested and transported to the station for further testing with the Intoxilyzer by a qualified breath technician.
Upon completing the Intoxilyzer test the accused, Nicholas Joseph Lapointe, 19 years of age, of Sarnia, was charged with a blood alcohol concentration of 80 plus.
On May 17, 2020, at approximately 9:45 PM, the Sarnia Police dispatch received a call by a complainant who was driving southbound on Tashmoo Avenue when another vehicle forced the complainant to veer onto the shoulder to avoid a head on collision. The suspect vehicle did strike the complainant’s vehicle causing some damage. The suspect continued to drive and failed to stop. The complainant followed the vehicle as it proceeded back into Sarnia.
The suspect parked his vehicle in the area of George Street and Vidal Street and walked away. Thanks to the complainant, police were able to locate the suspect driver and return him to the vehicle. As the officer continued his investigation he was able to form reasonable grounds to arrest the suspect driver for impaired operation without incident.
The suspect was transported to the Sarnia Police Station to be tested by a qualified breath technician on an Intoxilyzer Instrument. Once the test was completed results indicated that the accused had over three times the legal limit of alcohol in his blood.
The accused, Paul Bruce Sands, 43 years of age, of Walpole, faces the following charges:
- Impaired operation of a conveyance
- Operation of a conveyance with blood alcohol concentration of 80 plus
- Operation of a conveyance while prohibited under the Criminal Code of Canada
- Four counts of breach of probation
