A 33 year old male from Sarnia has been charged with refusing to provide a breath sample after being arrested for Impaired Driving.
On October 22, 2016 at approximately 3:45am, an officer with The Sarnia Police Service spotted the accused driving erratically at a high rate of speed on Devine Street, westbound toward East Street South. The vehicle was observed weaving within its lane and crossing over the center line. After stopping the vehicle, the officer noted the driver’s speech was slow and slurred, and his eyes were red and glossy. While continually fidgeting within the vehicle, the officer also observed an open bottle of wine in clear view. Upon exiting the vehicle, the driver was unsteady on his feet and was subsequently arrested for Impaired Operation of a Motor Vehicle.
The driver was then transported to The Sarnia Police Service where, after several failed attempts, he was unable to provide a suitable breath sample. As a result, he was also charged with Refusing to Provide a Breath Sample in addition to Impaired Driving.
The driver’s vehicle was impounded for seven days and his driver’s licence was automatically suspended for 90 days.
